Navigating Guardianship Filings: Key County Considerations
Hi, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we are going to be discussing guardianships, more specifically, we are going to discuss where you can file a guardianship.
Now this question has two potential answers. If you are directly related to the would-be ward, the individual that you would get a guardianship for, you can actually file for guardianship in the county that you live in.
Filing for Guardianships When Not Related
But, in certain situations, life is a little hectic, and things happen. You might need to file for a guardianship for an individual that you are not directly tied to, meaning you don’t have a familial relationship with them.
In the event that you have to file for a guardianship of an individual that you have no familial relationship with, you will need to file for that guardianship in the county where the ward lives. The state has a workaround to protect these wards if their family cannot take care of them.
Summary of Filing Locations
To summarize again, you can file in your own county if you are directly related to the ward. However, if you are not directly related to the ward in a familial fashion, you’re going to have to file in the county where those wards live.
