Understanding the Waiting Period for Remarriage in Oklahoma
Hello, I’m Oklahoma City attorney Dillan Savage of Wirth Law Office. Today we are going to be discussing the wait period that an individual has to go through to marry another person after they have completed divorce.
Put simply, you have to wait six months after your successful divorce to get remarried to another person. Now, that does not go into effect if you do want to remarry the person that you just divorced.
Reconciliation and Legal Implications
It’s pretty rare, but if you reconcile after successfully divorcing your ex-spouse and you two want to get remarried, that is allowed within those six months. However, if you have found somebody else after your divorce and it has not been six months yet, you will have to wait to get remarried in the state of Oklahoma.
There are also some legal consequences if you choose to marry in another state and then come back to Oklahoma. You cannot cohabitate with an individual that you are in a romantic relationship with the intent of marrying them within six months.
Potential Consequences of Premature Remarriage
If you do any of that—go out of state, get remarried, and then come back to Oklahoma—you may be charged with the felony of bigamy or adultery, depending on the circumstances. Additionally, if there is an appeal on your divorce decree, you must wait until 30 days after a final decision on that appeal before you can move forward with cohabitation or remarrying.
Of course, this still takes into account the six-month waiting period. To summarize, you are required to wait six months after your divorce to marry another individual unless you are trying to remarry your ex-spouse.
Important Considerations
Make sure that you do not cohabitate during this waiting period. While it is unlikely that law enforcement will pursue you for this, it is still considered a crime under Oklahoma law.
