The Price Isn’t Worth the Penalty
Video Transcribed: So, what is prostitution in Oklahoma? Hello, I’m Ty Smith, an Oklahoma City area attorney with Wirth Law Office in Oklahoma, it is illegal to engage in prostitution and/or solicit a prostitute. So maybe the first and most important part would be we need to define what is prostitution.
So, prostitution is the giving or receiving of sex, cunnilingus, anal sex, fellatio, and/or masturbation. Essentially engaging in masturbation for someone else, in exchange for money, or some other form of consideration, which is just a law school term for something of value.
So it should also be mentioned that scheduling an appointment to receive any of the things I’ve just listed, can also be considered prostitution or soliciting a prostitute. So, you obviously can’t do any of the above, but you also should know that you can’t be in a building or a vehicle for the purposes of receiving or soliciting a prostitute.
This is common, say in a brothel, or if you pick up a prostitute in your vehicle. That’s also not allowed by law. Now, you also can’t aid or abet the solicitation of prostitution. This is what’s commonly known as pimping, and that’s all covered under the statute of prostitution.
Now, the penalties for prostitution are misdemeanors, to be clear. The minimum that you’ll spend, you will spend in jail is 30 days, if convicted; maximum of one year. What varies are the amounts your fines are going to be. The first time, a first time you’re convicted, you’ll have… Remember, for every one of these offenses, for every time you’re convicted, you’re going to receive between 30 days and a year in prison, plus one of these fines here.
First offense, 2,500. Second offense, 5,000. The third offense and anyone after that is 7,500. And the judge might ask you to do some other things, maybe do some classes, maybe do some community service, but there are some other parts that judges typically tack onto that, which I think is important to consider.
