So what’s a moving violation in Oklahoma? Hello, my name’s Ty Smith, a lawyer in Oklahoma with Wirth Law. And this is a question that typically… Well, it applies to everyone who drives, but this will particularly apply to anyone who maintains a CDL driver’s license.
The point total you rack up on your license, kind of dictates your ability to work. So as the name might suggest, a moving violation requires that your vehicle be moving for an officer of the law to cite you for the given crime or offense there. And with every moving violation, there’s a certain point amount that is associated with it, which is a penalty. And racking up these points over the course of a certain period of time can result in a suspension of your license. Specifically racking up more than 10 points in the course of five years will result in the suspension of your license for some period of time.
Now, every moving violation’s a little different. Of course, the more dangerous they are, the higher your penalty is. For example, speeding. Speeding typically, generally up to 15 over, even 20 over is considered a pretty common movement violation. That’s only a two-point penalty, okay, against your license. Now, if you get up to 25 over, that’s called excessive speeding or aggravated speeding, and it’s a three-point violation.
Another common one is reckless driving, and we can talk about the elements of that one, but I don’t think it’s necessary here. That’s going to earn you five points against your license. Okay. Now, some of those are also serious moving violations, which we’re going to cover in a different video, a follow-up video, and why you should know about what a serious violation is and how it affects your CDL.
