In the event that you are in fact a victim of domestic violence or stalking and you have filed your petition, you can request through an application for attorney’s fees for your attorney’s fees to be paid during the case itself, such as a divorce or a paternity case. You can request that those interim attorney’s fees be paid for and you can also request that at the end during the final order process.
Process of Requesting Fees
Once you get that final order, you can request your attorney’s fees be paid for on whatever else you have left. Of course, those attorney’s fees have to be reasonable in form, and in order to actually get that application granted by the court, you have to show by what is called a preponderance of the evidence that stalking or domestic abuse occurred.
This evidence must demonstrate that the reason you filed your petition for divorce or paternity was due to domestic violence or stalking. A preponderance of the evidence means that you present proof indicating it is more likely than not that your claims are valid.
Proving Your Case
If you can show that it is more likely than not that you were stalked or domestically abused by the other party, it is highly likely that the court will grant you your reasonable attorney’s fees. After you have filed your petition in a custody matter and applied for attorney’s fees, as long as you can prove your case convincingly, you may be able to receive a substantial amount of your attorney’s fees covered.
While it might not cover the entire amount, it can significantly alleviate the financial burden of legal fees during a challenging time.
