Understanding Same-Sex Marriage Laws in Oklahoma Today
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we are going to be talking about whether or not same-sex marriage is legal in the state of Oklahoma. Simply put, the answer is yes.
As of October of 2014, it became legal in the state of Oklahoma to have same-sex marriages. It really took off in the year of 2015. The same requirements of your just man-woman marriage are the same requirements as a same-sex marriage in the state of Oklahoma.
Requirements for Same-Sex Marriage
So you’re looking at individuals that are over the age of 18 in most cases. There are some addendums to that, and I go over those little nuances in another video. Now with that in mind, with the fact that same-sex marriage is legal in the state of Oklahoma, there is something to take into account that might be a hiccup if you are moving to the state of Oklahoma.
Under the statutes of Oklahoma, the law of Oklahoma as of 2023, there is a statute under Title 43, Section 3.1 that states the state of Oklahoma will not recognize a same-sex marriage that was conducted in another state. However, if you are married in the state of Oklahoma with a same-sex marriage, you should not have an issue.
Legal Nuances and Recognition
Now that statute specifically states it is the recognition of marriage between persons of the same gender prohibited. That is Title 43, 3.1, a marriage between persons of the same gender performed in another state shall not be recognized as valid and binding in this state as of the date of their marriage. Again, however, if you are married in the state of Oklahoma, your same-sex marriage will be considered valid and legally binding.
