Understanding the Process of Restoring Your Maiden Name
Hello, I’m Oklahoma City attorney Dillan Savage of Wirth Law Office. Today we are going to be discussing whether or not you can get your former name or your maiden name restored to you through the process of a divorce.
Oklahoma has put this into law under Title 43, Section 121. This section has quite a bit of information, but you will find at the very top that it states that either a man or a woman can be restored to their former last name through divorce proceedings.
Steps to Ensure Your Maiden Name Restoration
To do this, you’re going to want your final decree to explicitly state what your name currently is through the marriage and what your last name is going to be restored to. Once you’ve done this, you’re going to want a few certified copies of that final decree to take to the DMV.
You’ll also need to send that to the IRS and a few other places to make sure that everything’s updated, including your driver’s license and your taxes. You want to ensure that all relevant government agencies follow your name change.
The Importance of Including Your Name Change in the Final Decree
It’s as simple as making sure that your name change is included in your final decree. If you do not have that in your final decree, you’re going to have to hire another attorney to do a formal name change proceeding. This process is much easier to accomplish through your divorce, so it’s not worth forgetting to do.
