Understanding Custody Preferences for Minor Children
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we are going to be talking about individuals who can have custody or guardianship of minor children and the preference of the state for those individuals to have custody and guardianship of minor children.
So number one, as most would assume, the court is going to prefer that parents, one parent or joint parents, both of them, have custody or guardianship of their minor children. Now in the event that the parents are not able to have custody or guardianship of their children, the court will go to the second in line of their preference, which is going to be the grandparents of those minor children.
Custody Preferences Beyond Parents
So after that, if the grandparents are not able to provide guardianship of these children, the court will look at an individual or individuals that the parents have indicated should be the guardian of these minor children in the event that they are unable to have custody of their children or that they have deceased their children. Next, after that, you would see a relative of either parent.
If a relative is willing and able to provide a guardianship, they can step forward as the next preferential guardians. After that, the court is going to look at individuals who have provided a safe and caring home for the children, somewhere where their needs and requirements are met, such as a foster parent or another familial member that is distantly related or even a friend of the family, as long as they are meeting those requirements and the children have been residing with them.
Final Considerations for Guardianship
And then lastly, number six, the court will consider any other individual that can meet the requirements of the children and provide them with a safe, loving, and caring environment as long as the court deems them suitable as a guardian for these minor children.
