If you have not resided in Oklahoma for six months or longer, you’re not going to be able to file for divorce here. However, this does not mean you can’t ever file; it just means you need to wait until you have completed the six-month residency requirement. At that point, you will have established yourself in Oklahoma as a resident.
Filing Your Divorce: Choosing the Right County
Your next step after meeting the residency requirement is to determine which county you can file your divorce in. You will look at which county you have lived in for at least 30 days or longer. Additionally, if the other party has resided in Oklahoma for at least six months and has a county where they have lived for 30 days or longer, you can also file in their county.
To summarize, to file for divorce in Oklahoma, you must have lived here for six months or longer. The location for filing will be either the county where you have lived for 30 days or longer or the county where the other party has lived for the same amount of time.
