So, mediation, just to start off, let’s define that. Mediation is where two separate parties, or even maybe more than two separate parties, will go to a neutral location with or without their attorneys in the hopes of settling their case together.
The Importance of Mediation in Custody Matters
Whether or not it is a full settlement or a partial settlement, mediation can be changed up a little bit. You can have all the parties in one single room, or the parties can be separated into different rooms, and the mediator, the neutral party, can go from room to room discussing and bringing the different counteroffers between the parties in order to try to settle the custody case or whatever case you might be having.
The reason that mediation is so important to the court and why it’s crucial for custody matters is that it avoids lengthy litigation and fights that need not occur. For instance, if you go to mediation and both parties agree that there should be joint custody, you can write that agreement out at mediation.
Benefits of Reaching Agreements through Mediation
Even if you have other issues that you don’t agree on, setting that particular issue of joint custody aside means it does not need to be litigated at trial. In the event that the parties are able to come to a full agreement, you can write that settlement agreement up at mediation and completely avoid trial.
This is not only important to the parties but also to the court. At that point, the court doesn’t have to worry about a case wasting their time on the docket that should have settled in the first place, and they can simply review your full agreement, sign it, and get your case off the docket.

This process saves you time, money, and headaches, which is why mediation is so important to really any case that’s out there. This is particularly true for custody matters because it helps keep children from being placed in a position where there is lengthy litigation going on between their parents.
