What’s Yours, What’s Mine, and What’s Ours
Video Transcript: Hello, everybody. This is Dustin Peterson and I am The Oklahoma City Attorney.
We’ve been talking quite a bit about equitable property division in divorce. And today’s topic is going to be about whether separate property can actually be acquired during the marriage. And surprisingly, yes it can.
For example, if you have just gotten married and your parents give you, say, $5,000 to buy a new wardrobe because you’ve just landed your first corporate job and you need nice clothes, that’s probably separate property.
However, if your parents, just after you’re married, give you $10,000 to go on a honeymoon with your spouse and then divorce happens before you leave, that’s probably marital property. Also, what if you receive an inheritance from a rich aunt? That’s probably separate property.
However, what if you receive an inheritance from a rich aunt that the amount of which is based on care that you gave to the aunt prior to her passing? That might be marital property actually, because it’s considered income into the marriage.
