Understanding the Husband’s Legal Role During Separation
Hello, I’m Oklahoma City divorce attorney Dillan Savage of Wirth Law Office. Today we are going to be talking about your liability to provide certain support for your spouse in the event that they either abandon you or you are separated.
So you can find this statute in Title 43, Section 210. This statute is very centered around the man’s obligation to provide for his wife in certain events. It does not really center around women’s liability towards providing for their husbands.
Obligations in Marriage and Separation
In another video of mine, I discuss how husbands have certain obligations and wives have certain obligations, and it is a little bit different. Those obligations, of course, pertain to the duration of the marriage. As a husband, you have different responsibilities compared to those of your wife.
According to the statute, Section 210 in Title 43 states that in the event that a wife abandons her husband, the husband is under no obligation to support her unless the abandonment was due to misconduct by him, such as domestic abuse or other serious issues.
Clarifying Support During Separation
Moreover, the statute clearly indicates that if the parties are separated by agreement, the husband again does not have to provide support for the wife unless it is explicitly stipulated in the separation agreement. To recap, if the wife abandons the husband without good cause, he has no obligation to support her until she offers to return.
It specifically states that word for word: until she offers to return to him. Additionally, if the parties are separated, there is no obligation for support during that separation unless it is part of the separation agreement.
Word-for-Word Clarity on the Statute
I am now going to read the statute word for word so there is no confusion: A husband abandoned by his wife is not liable for her support until she offers to return unless she was justified by his misconduct in abandoning him, nor is he liable for her support when she’s living separately from him by agreement unless such support is stipulated in the agreement.
