Holiday and Summer Visitation: What You Need to Know
Hi, my name is Dylan Savage of Wirth Law Office. Today we are going to discuss the issue of holidays and summer visitation whenever you have a divorce or you have a paternity lawsuit. Most counties are going to have some type of in-place schedule, and in those schedules, for holidays you’re going to see one parent, you know, have Christmas one year, and another parent will have during that year Thanksgiving.
As such, just from those facts alone, you can probably infer that the holidays will switch off and on every year. This is pretty normal; this is what most countries do. They try to make it as even as possible for parents so both parents and parties can have as much time with the children or child as possible when it comes to holidays.
Modifying Existing Visitation Schedules
A lot of people might wonder, well can we change this if these counties already have an in-place holiday schedule? The answer is yes; there is no problem with that as long as both parties agree or there is a good argument at trial. Almost anything can be modified or changed.
Now as for the summertime visitation, it will again depend on the county. Some counties have week-on-week-off arrangements, while others have it where the non-custodial parent, or in some cases if you have equal time, both parents will have a certain extended amount of time.
Understanding Summer Visitation Dynamics
For example, if you had week-on-week-off during the school year, it might transition to a schedule where this parent has two weeks during the summer and then this parent gets the next two weeks. Again, this can easily be changed by agreement. Everything is known in the court system to be able to be agreed upon in some type of change. Everything is able to be deviated from.
