Video Transcribed: Do I need a good reason to divorce my spouse? Hi, I’m Ty Smith, Oklahoma City Area Lawyer with Wirth Law. When people come into our office or call me, they ask me this question way more often than I thought people really should.
The quick answer is, no, you don’t need any reason at all to divorce your spouse. Used to be, and maybe this is probably where this question’s coming from, you used to have a good reason. He cheated on me, he beats me, he drinks excessively, whatever. But now you don’t have to have that.
Matter of fact, in most divorces, I’ve actually never come across any divorce that didn’t cite this, you just have to cite, irreconcilable differences, which essentially means, “I don’t want to be with this person anymore.” And that’s fine. Oklahoma doesn’t want to force you to be with someone you don’t want to be with, which is great in my opinion.
So you don’t need a good reason. You just have to have a reason, which is, “I don’t want to be with them anymore.” Which is reason enough. So if you find yourself not wanting to be with your spouse anymore, but you’ve been holding off for some reason, maybe he comes home drunk or something, or she maybe is allegedly cheating with someone, whatever, you don’t have to do that, okay.
