Child support arrearage, just to define it real quick, is the money that has built up over time that you have not paid regarding child support.
If you are missing months’ worth of payments of child support, it creates an arrearage, an amount that you owe that you’re behind on. If it gets bad enough and you get dragged into court, you may need to pay that money off. Alternatively, you might just want to ensure that you have paid up any arrears that you have accrued.
Options for Paying Off Child Support Arrearage
You can pay off your arrearage in a lump sum. A lot of people will move forward with that option if they can do so. Of course, the other side is going to be pretty happy receiving that lump sum amount of money.
However, if the arrearage has become too large for you to pay in one go, you will need an arrearage payment schedule. Simply put, this is a payment schedule designed to help you pay off your arrearage over time.
Creating a Payment Schedule
With an arrearage payment schedule, you will continue paying your normal child support and add a smaller amount on top of your child support payments. This additional amount is meant to pay off your arrearage in no less than three years.
In fact, by Oklahoma law under Title 43, Section 137, you cannot have that arrearage payment schedule extend beyond three years. The law aims to prevent excessive burdens on individuals, ensuring that the payment schedule remains manageable.
