Understanding Custodial Parents’ Rights to Relocate
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we are going to be talking about the rights and ability of a custodial parent to change the residence of their minor child. This is a very brief lowdown of the ability of that custodial parent to move residences.
As common sense would tell you, if you have custody of your child and you are the custodial parent, yes, you can move their residence; you can move where they are living. This is put in concrete form under Title 43 in Section 112.2a. The court may restrain that move of the minor child’s residence in the event that the court determines it would prejudice the child or their welfare would be in harm’s way if the child was moved.
Legal Considerations for Relocation
Now this is all going under the assumption that you are the custodial parent without having to worry about any other individuals. In the event that you have had a divorce or a paternity lawsuit and there is another individual with custodial rights, you do need to worry about Title 43 Section 112.3, which is called the relocation statute.
If you are going to relocate and there is another party with custodial rights or they have at least visitation rights with the minor child, you are going to need to notify them if you intend to move 75 miles or more from your current residence. Each parent should always be aware of where the minor child is living, but in the event that you are going to move a greater distance, you need to notify the other party so they can raise their objection and be aware of your intent.
