So, right off the bat, it’s pretty easy to answer the question, unfortunately for many individuals, the answer is no. You are not going to be able to reclaim that wedding band unless the parties agree to do so.
The Legal Perspective on Wedding Bands in Divorce
If it comes to a trial, there is a lot of case law that has been determined by the Oklahoma courts that you will not be able to get that wedding band back. It is considered a gift, and so in order to get that wedding band back in any way, shape, or form during your divorce, you are going to have to come to an agreement with what will eventually be your ex-wife.
To clarify, if you are getting a divorce and you want your wedding band back, whether or not it is from your ex-wife or ex-husband, you are not going to be able to get that wedding band back without an agreement. It has been established that those are considered gifts and that you cannot get those back any other way except by agreement.
