Understanding VA Disability’s Impact on Alimony Decisions
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today, we are going to be discussing whether or not your VA disability, your Veterans Affairs disability, can be used in determining whether or not you can pay for alimony.
Alimony is based upon one party’s ability to pay and the other party’s need for support. Now, if the only income that you have is VA disability, then the other party is out of luck because VA disability cannot be used to determine your income in regards to alimony payments.
Legal Protections for VA Disability Income
If all you have is your VA disability, it will be reflected under alimony calculations that you have no income. This is protected under Title 43, Section 134, which specifically states that your VA disability will not be included in determining an income when it comes to alimony.
So again, just to wrap this up, know that your VA disability cannot be used in determining alimony payments. It’s important to understand these legal protections so that you can navigate your financial responsibilities effectively.
