Video Transcribed: Can I be charged with sexual assault in Oklahoma? Hi, I’m Ty Smith, a lawyer in Oklahoma City with Wirth Law. And anytime someone asks me if they can be convicted of a certain crime, I always remind them that the state has the burden. They have to prove beyond a reasonable doubt that you committed this crime. And for sexual assault, they have to prove, beyond a reasonable doubt, that you intentionally made contact with another person’s body, specifically the private parts or private areas, without their consent.
Now, punishment for this crime, if convicted, ranges, very kind of widely actually. If you touch someone, or you’re convicted of sexual assault of someone who’s over the age of 16, the range of punishment range between a year in prison to 15 years in prison. If you touch someone who’s under the age of 16, sexual assault under the age of 16, increases by five years, one to 20. And regardless, after you serve your prison time after you get out, you’re probably going to have to register as a sex offender for a certain amount of time, depending on what level of sex offender you plead to or are convicted.
And it’s imperative that if this is your situation if you’re being charged with sexual assault, that you get an experienced attorney on your side to make sure you get a fair shake at trial or at least in court. And I would love to be that attorney for you.
Once more, I’m Ty Smith, an Oklahoma criminal defense attorney. You can find me at theoklahomacityattorney.com. You can call me at (405) 888-5400, and I would love to speak to you about this matter, or any other legal matter for that matter.
