Understanding the Essentials of Supervised Visitation Law
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we will be discussing supervised visitation. So Oklahoma law actually defines supervised visitation under Title 43, Section 110.1a and it is defined as meaning the court-ordered contact between a non-custodial parent and one or more children of such parent in the presence of a third party who is responsible for observing and overseeing the visitation in order to provide for the safety of the child and any other parties during the visitation.
So what does that mean in plain English? It means that an individual that has been selected as the supervisor for visitation just simply watches and observes during your visitation with the child or children. And who can be these supervisors? Well, here in Oklahoma County they provide quite a list, so there are several individuals to choose from.
Who Can Supervise Visitation?
There are also a few facilities in the Oklahoma City area that provide supervised visitation that can occur at their facility or that they can follow along with you. Supervisors can also be family members in certain cases if the court approves that to occur. Now supervised visitation can occur because of abuse of drugs, alcohol, or domestic abuse.
There are actually a few instances where it goes farther than that. It really comes down to whether or not the court has a fear for the children’s safety. At that point, they put in place supervised visitation if they don’t decide to just put off your visitation completely.
The Purpose of Supervised Visitation
The court wants parents to have a relationship with their children, and that is one of the reasons why they have supervised visitation. This arrangement allows you to address the issues that are causing the need for supervision and move forward with having that parent-child relationship again. Again, that definition and law that defines supervised visitation is found in Title 43 Section 110.1a.
