Video Transcribed: Okay, so what is indecent exposure in Oklahoma? Hi, I’m Ty Smith, an Oklahoma City area attorney with Wirth Law, and this one may seem lewd if you will because that’s kind of the nature of the crime.
Maybe it’s best if we read straight from the statute to figure out what this is. Title 21, sections 10-21 lays this out for me. Forgive me if I just kind of read along. Indecent exposure is the intentional and lewd exhibition of one’s genitals or body parts in public or in the presence of anyone who would be offended or annoyed by such a display. Okay, so exhibition, if you didn’t know what that means is a fancy way of saying display, an exhibit, if you will. Another way of looking at this is flashing. You have shown yourself, you have exposed yourself to someone who didn’t want it, who didn’t want to see that, okay?
And that’s kind of it. Okay? That’s it, all right? It is a sexually based crime, and as such, you risk being placed on the sex offender registry if convicted for this. You also face a minimum of 30 days in jail and a maximum of 10 years depending on who you expose yourself to. You also face anywhere between a 500 and a $20,000 fine, once more depending on who you expose yourself to. Now, it’s important that we point out that in 2011, it was clarified that public urination is a separate offense, okay? It’s a misdemeanor that one, okay? That is not a sexually based crime, so that is not the same. While technically, yes, if you urinate in public and someone sees you doing it, you have committed indecent exposure. To land an indecent exposure charge along with public urination, they’re going to have to show that you were urinating and then also doing a little something extra, which is harder to define exactly, and not really the place for it in a three-video, but that is indecent exposure.
As I said, it is a sexually based crime, so please do not be one of those that just take this on the chin, okay? You need legal representation on this because the sex offender registry has the potential to really hurt you in the long run.
