There Has to Be Big Enough Evidence to Prove You Are Violent
Video Transcribed: Can an allegation of domestic violence affect your custody visitation rights with your kid? Hi, I’m Ty Smith, a lawyer in Oklahoma with Wirth Law, and we get this question a lot with people who have been accused of domestic violence with their former significant other.
The short answer is yes, it can be considered, at least in the temporary, meaning the temporary orders here in Oklahoma. As we’ve spoken of in a previous video, temporary orders are simply the ground rules that lay the bridge, lay the groundwork for what’s life going to look like until a final decision is made by the judge. Another big theme, a big thing that we’re going to want to follow today is what’s in the best interest of the child. Always keep that in mind because that’s what the judges are always keeping in mind.
Think to yourself, if you heard about a potentially domestically violent individual wanting to have custody visitation rights with their kid, would that give you pause? Most of us would say yes because you don’t want someone who’s violent to be hanging out with kids. Now, this doesn’t mean that it’s going to permanently keep you away from the kid.
Most judges will maybe keep you away from it temporarily until there’s been a proper investigation into the domestic violence and the judge will weigh whether the amount of evidence against you is big enough to merit some type of taking away of visitation rights to your kids or custody of your kids, but that is going to be the part of your lawyer to come in and minimize or even quash the allegations of domestic violence, which is where I come in.
