There Has to Be Enough Evidence for an Arrest Warrant
Video Transcribed: Okay, so we’ve previously spoken about warrants. Today let’s talk about arrest warrants. Hello, I’m Ty Smith, a lawyer in Oklahoma City with Wirth Law, and I think arrest warrants are typically much more interesting for people to learn about because they involve the taking of a person and not just stuff.
So what a warrant is, as previously stated, a warrant is a judicial authorization to do something. An arrest warrant is a judicial authorization to take someone and put them in jail. And this can only be achieved if a law enforcement agent brings before a judge sufficient evidence that you, or whoever’s named in the warrant, committed a crime or probably committed a crime and at least needs to be brought in for questioning.
So bring it before the judge, judge signs off on it, they can come get you. Now, they don’t always need a warrant to come get you. They being law enforcement agents, if they see you commit a crime, they can take you to jail, but to actually come get you if they don’t see it, they do need an arrest warrant.
Now, if you find out that you have an active warrant for your arrest, the best thing to do is contact an attorney. Now, the attorney isn’t going to get you out of the warrant. The warrant has been issued and probably going to tell you to submit to the warrant. Matter of fact, they’re almost certainly are going to because to tell you otherwise would be to tell you to break the law. An attorney’s not going to tell you to do that.
But what an attorney can do is they can help facilitate a quick release. They can work with a bondsman, they can find out your bond first off, and then they can work with a bondsman to get that paid and get you released, which is very important to people because otherwise you’re sitting in jail, you’re not working, you’re not taking care of your responsibilities.
