As I have discussed in previous videos, a divorce has to have a good solid reason. It could be that you are just incompatible individuals, it could be for infidelity, or any other number of reasons that I have listed in a previous video.
Mutual Consent for Legal Separation
In contrast, a legal separation can occur simply due to mutual consent of the parties involved. You don’t have to jump through a bunch of hoops; the parties just have to be in mutual agreement that a legal separation would be the best option for them at this time.
If you are looking for a way to give yourself some time and provide your marriage with some breathing room, a legal separation is a viable option if both parties agree to it. You can request many of the same arrangements that would be addressed in a divorce.

This includes discussions about asset distribution, child support, and other essential matters while you work on your marriage. This process can help clarify each party’s expectations and responsibilities during the separation period.
