Hello, I am Dillan Savage of Wirth Law Office – Oklahoma City. Today we will be discussing again ways to terminate alimony. Specifically, we will be talking about terminating alimony due to the recipient living and cohabitating with a member of the opposite sex or with a new significant other.
You can find this in Title 43 section 134 subsection c. If you have an individual who is receiving alimony payments from you, that recipient can lose their alimony payments if you motion the court to terminate alimony based upon the fact that they are cohabitating with an individual of the opposite sex as described in Title 43 section 134 subsection c.
Reasons for Termination of Alimony
The reason for that is their circumstances are going to have most likely significantly changed by cohabitating with that individual. This could be a romantic relationship or any type of relationship that they have with one another, as long as it affects their financial situation. Essentially, it makes them better off, which can eliminate the need for alimony.
As I’ve discussed in a previous video, alimony is based on a party’s need and another party’s ability to pay that alimony. If that need is no longer present because they are cohabitating with a member of the opposite sex, then you can motion the court to terminate that alimony.
