Understanding Child Support Modifications in Oklahoma Cases
Hello, I’m Attorney Dillan Savage of Wirth Law Office – Oklahoma City. Today we will be discussing whether or not child support services can unilaterally go in and modify your child support computation after it’s already been put into place.
Child support services, if you are receiving services from them such as SoonerCare, will likely be involved in your case. Whether it’s a divorce or paternity case, as long as there is child support involved and you are receiving state assistance, they are typically going to be involved in your child support case.
The Role of Child Support Services
At that point, child support services conduct regular reviews of child support computations to ensure everything is up to date. If they review your child support and determine that it does not reflect your current financial status or information in the child support computation, they will get involved and notify the parties.
Following notification, your child support case will be moved to what is called the Office of Administrative Hearings. This entity operates separately from the district court, focusing on administrative-type hearings such as child support modifications.
What Happens During a Modification Review?
Once the parties have been notified that a modification is being considered, you will have the opportunity to present any additional information that may contest their findings. If you have valid evidence to show that the current child support computation is incorrect, you should provide it at that time.
However, if child support services determine that the computation is indeed accurate, they have the right to modify your child support obligations accordingly. It’s essential to understand that this process is designed to ensure that child support amounts accurately reflect the financial circumstances of both parties.
