Understanding Parental Rights to Child Records Access
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we are going to be discussing whether you as a non-custodial parent can still have the same access to the records of your minor child or minor children as the custodial parent.
So the answer is yes, you still have every right to all of that documentation upon request. The only exception is if the court determines that it is not in the best interest of the minor child or minor children that you not have access to those documents and records.
Understanding Your Rights Under the Law
Specifically speaking, under Title 43, Section 109.6, the statute is called certain information and records to be available to both custodial and non-custodial parents. Any information or records relating to your minor child or minor children that the custodial parent has access to, they must allow you to have that same access upon request.
Again, the only reason that you should not be able to get those records is if the court has ordered that you not be allowed to get those records for the best interest of the children or the child.
Types of Records You Can Access
You may have a question of what those records may include. It’s not limited to this, but it could include information such as medical information, school information, pretty much anything and everything that you could normally get from your child and for your child as a custodial parent.
You as the non-custodial parent can also get access to these important records. This ensures that you remain informed about your child’s well-being and are able to participate in their lives despite the custodial arrangement.
