Understanding Custody Matters and Your Parental Rights
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City. Today we are going to be discussing what you as a parent can do during a custodial matter such as a divorce or a paternity lawsuit when you have fears that there is potential danger to your child or just a bad living situation for your children while they are in the care and custody of the other parent.
This discussion focuses on situations that differ from those involving known imminent danger to the children. If you have firsthand knowledge or can obtain proof that there is imminent danger to your child in the care of the other parent, you can pursue what is known as emergency custody. In such cases, the court will hear evidence and may grant you custody immediately to protect your children.
Steps to Take If Your Child is Not in Imminent Danger
In situations where you do not have direct evidence that your children are in imminent danger, there are several steps you can take. First, if you are represented by an attorney, it’s crucial to contact them and share your concerns. They can reach out to the opposing counsel to discuss the matter and find a resolution.
Another option is to request a welfare check from the local police department. They can investigate and determine if any necessary action is required based on what they find. While it’s typically not advisable to contact Child Protective Services or DHS without a pressing reason, it remains an option if your concerns are significant. If you choose to go this route, they will assess your report and decide whether to initiate a case.
What to Expect from Child Protective Services
When you contact Child Protective Services or DHS with your concerns, they will screen the information you provide. If they find no grounds for a case, they may dismiss it. However, if they identify legitimate safety concerns, they will proceed to open a case, conduct home visits, and interview both parents and the children involved. This process helps determine whether your concerns are valid and if emergency custody is indeed necessary.
