Understanding Dynamics of Guardianships
Hello, I’m Oklahoma City family law attorney Dillan Savage of Wirth Law Office and I practice out of the Oklahoma City, Oklahoma area. Today we are going to be discussing guardianships of minor children and more specifically the length of those guardianships.
So a lot of the time I will have a client that happens to get a guardianship of a minor child and they will look at me after they’ve gotten their letters of guardianship and go, Do we have to come back? Do we have to redo this? How long is this guardianship going to last? It’s a bit of a mixed bag in that because a guardianship is meant to be temporary in nature.
The Nature of Guardianships
However, if the problem that created the need for the guardianship is not fixed, you just keep the guardianship in place until the child turns 18, and that is an option. For example, if there is a DHS case and that was the reason for the children’s need for a guardianship, and the parents were to fix all the problems and come back to start the reunification process, then the guardianship could be terminated.
In that scenario, the children could be reunited with the parents, and that would be the end of the guardianship. The purpose of the guardianship is simply to address the risks to the children and ensure they are in a safe position until the need for the guardianship is resolved.
Annual Reviews and Responsibilities
Now during the guardianship itself, once you have finished the entire process and you have the final order of guardianship, you will have an annual revisit of the guardianship just to check on the child. This involves ensuring everything is going well and that the child is being taken care of financially, physically, and emotionally.
