Understanding Tax Claims for Children in Custody Situations
Hello, my name is Dillan Savage of Wirth Law Office and I practice primarily out of Oklahoma City, Oklahoma. Today we are going to discuss tax claiming in custody matters and who gets to claim the children on taxes every year.
For the most part, the parties will in many cases switch on and off for tax claiming. For instance, one party may get the even years to claim a child or the children while another party would have the odd years. This arrangement is often determined by the court to ensure fairness.
The Fairness of Tax Claims in Custody Cases
If you have numerous children, it is common for the court to determine that it would be best for both parties to be able to claim a child. For example, if you have two children, one party would claim one child while the other party would claim the second child. When one child ages out to 18, the parties can then switch off and on every other year.
This method makes it fairly even for both parties, ensuring that neither party is at a disadvantage in tax claiming. This consideration applies even to parties that only have standard visitation rights; you still retain the right to claim your children on taxes.
The Court’s Role in Tax Claim Decisions
The court is very fair when it comes to tax claiming and strives to make sure that neither party is at a disadvantage. This impartiality is crucial in maintaining a balanced and equitable approach for all involved.
