Understanding the Divorce Waiting Period in Oklahoma
Hello, my name is Dillan Savage of Wirth Law Office – Oklahoma City and today we are going to go over the length of time that you have to wait until your Oklahoma divorce can be finalized. So fairly simply, there is going to be a set number of days after the point that the case is open that you have to wait until the judge will actually sign off on your paperwork. There is a way around that and we will discuss that towards the end of this video.
Waiting Periods Based on Children
If this is a divorce without children, you can be divorced within 10 days. You have a 10-day waiting period that you must wait; otherwise, you cannot have your paperwork finalized. In the event that you have children in your divorce, you have a 90-day waiting period. This is referred to as the 10 to 90-day waiting period. Without children, you wait 10 days, and with children, you wait 90 days.
Now, there are certain circumstances where you can request the judge to waive that waiting period. A lot of the time this will happen where parties come in and they already have a full agreement. There\’s really no argument between the parties, and everything\’s written up, signed, notarized, and good to go. It\’s just dropped off at the judge, who will look at the paperwork, determine that it is fair and just, and sign off on a waiver of that wait period.
Possibility of Waiving the Waiting Period
I personally have been able to close a case within about seven days with children. Normally, you\’d have a 90-day waiting period, but I got it closed right up simply because the parties were able to get along so well that the agreement was written up almost immediately and set before the judge as soon as that case was basically opened.
To summarize, your waiting periods for divorces with children is going to be 90 days, and without children, it’s 10 days, unless you can really work together and the judge feels that your agreement is fair enough that they’re okay with waiving that waiting period.
