Capital murder is often seen as the worst of the worst – the worst offense that you can commit, or the worst thing you can be sentenced for.
If you didn’t know, capital murder, of course, means murder in the first degree, with some aggravating circumstances.
Here are some examples:
- The defendant was previously convicted of a felony involving the use or threat of violence to the victim
- The perpetrator committed the murder as a murder for hire. Or the person on the hook for murder hired someone else to murder that person (ex: hitman)
- The murder was committed to avoid lawful arrest or prosecution. For example: If someone was going to “rat you out” and you killed them? Or maybe, if you killed an investigator
- If the victim of murder was some type of law enforcement officer and that person was killed in the performance of their official duty
- If the defendant knowingly created a great risk of death to more than one person – think of a terrorist attack
- If the murder was especially heinous, atrocious, or cruel, this is known as the hack. These are like poisoning, over-the-top violence
