- Willfully causing the cash register or other sales recording device to reflect less than the full retail value of the goods.
Any person convicted of shoplifting shall be punished as follows:
For a first or second offense, the person shall be guilty of a misdemeanor punishable by imprisonment in the county jail for a term not to exceed thirty (30) days or by a fine not to exceed Five Hundred Dollars ($500.00) or by both such fine and imprisonment; and
For a third or subsequent offense, the person shall be guilty of a felony punishable by imprisonment in the custody of the Department of Corrections for a term not to exceed five (5) years or by a fine not to exceed One Thousand Dollars ($1,000.00) or by both such fine and imprisonment.
