Petit Larceny Can Have Major Consequences
Shoplifting is a crime that occurs when individuals unlawfully take or carry away merchandise from a store with the intent to permanently deprive the establishment of its value without paying for it. In Oklahoma, the law defines shoplifting as a form of larceny committed within the premises of a retail establishment. If you or a loved one have been charged with shoplifting in Oklahoma, you need a Wirth Law Office – Oklahoma City attorney that knows the best defense for you.
Shoplifting Scenarios and Definitions
Shoplifting can take various forms within a retail setting. The most common scenario involves physically leaving the store with stolen merchandise. However, Oklahoma law also considers actions such as intentionally swapping price tags to pay a lower price for an item. Even if the theft occurs before leaving the store, hiding stolen goods on one’s person (e.g., under clothing) can still lead to shoplifting charges.
Penalties for Shoplifting
The Oklahoma statute that addresses shoplifting is Okla. Stat. tit. 21 § 1731. This statute defines and outlines the offense of shoplifting in Oklahoma. Here is the relevant excerpt from the statute:
Shoplifting shall consist of the following:
- Willfully concealing or taking possession of unpurchased goods held for sale by any store or other mercantile establishment with the intention of converting such goods to such person’s own use without paying the purchase price thereof;
- Altering, transferring or removing any label, price tag, marking, indicia of value or any other markings which aid in determining value affixed to any goods held for sale by any store or other mercantile establishment and transferring such label, price tag, marking, indicia of value or other markings from one piece of merchandise to another with the intent to purchase such merchandise for less than the full retail value;
- Transferring goods held for sale by any store or other mercantile establishment from one container to another with the intent to purchase such goods for less than the full retail value; or
- Willfully causing the cash register or other sales recording device to reflect less than the full retail value of the goods.
Any person convicted of shoplifting shall be punished as follows:
For a first or second offense, the person shall be guilty of a misdemeanor punishable by imprisonment in the county jail for a term not to exceed thirty (30) days or by a fine not to exceed Five Hundred Dollars ($500.00) or by both such fine and imprisonment; and
For a third or subsequent offense, the person shall be guilty of a felony punishable by imprisonment in the custody of the Department of Corrections for a term not to exceed five (5) years or by a fine not to exceed One Thousand Dollars ($1,000.00) or by both such fine and imprisonment.
