What are 85% Felonies in Oklahoma?
85% felonies are crimes that require you to serve at least 85% of your imprisonment sentence before you’re eligible for parole consideration. These are all considered violent or sexual felonies. By contrast, if someone commits a crime not under this category they may only have top serve 25% to 33% of their sentence before parole. So that’s the big distinguishing factor between them.
Crimes With Mandatory Minimum of 85% Sentencing
Persons convicted of:
- First degree murder
- Second degree murder
- Manslaughter in the first degree
- Poisoning with intent to kill
- Shooting with intent to kill, use of a vehicle to facilitate use of a firearm, crossbow or other weapon, assault, battery, or assault and battery with a deadly weapon or by other means likely to produce death or great bodily harm
- Assault with intent to kill
- Conjoint robbery
- Robbery with a dangerous weapon
- First degree robbery
- First degree rape
- First degree arson
- First degree burglary
- Bombing
- Abuse, neglect, exploitation or sexual abuse against a child
- Forcible sodomy
- Child pornography or aggravated child pornography
- Child prostitution
- Lewd molestation of a child
- Abuse of a vulnerable adult
- Aggravated trafficking in illegal drugs
- Aggravated assault and battery upon any person defending another person from assault and battery
- Human trafficking
Engaging in any of these criminal activities will mandate a mandatory minimum of serving 85% of the imposed prison sentence before becoming eligible for parole consideration. Those found guilty of these offenses will be ineligible for any form of earned or other credits that may otherwise reduce the sentence duration to less than 85% of the initially imposed term.
